Right of Way & Claims Agent - Billings

Job Role Summary

Plan, direct, and coordinate the activities and services of the Right of Way & Claims Department with Management and other departments and functions (i.e., Operations, Integrity, Business Development, Financial Services, and Shared Services) in the acquisition, protection, and preservation of property rights, license/lease/rental agreements, and regulatory approvals/permits for all pipeline, light products facilities, and other ExxonMobil assets.  Ensure regional consistency for field support, support large project implementation, and coordinate and provide guidance to personnel in the rationalization and jurisdictional responsibilities for property rights associated with ExxonMobil’s assets.

Position is located in ExxonMobil Pipeline Company’s Billings, MT field office.

Job Role Responsibilities

Perform all aspects of right-of-way and real estate-related activities to maintain and protect ExxonMobil Pipeline property rights; negotiate favorable terms for land and right-of-way (“ROW”) agreements, including the acquisition, relinquishment and modification of easements, fee land purchases, franchise and permit rights, encroachment resolutions, and settlement of damage claims.

Steward contract ROW firm/agent team(s) in the performance of all aspects of right-of-way and real estate related activities.  Assist as needed to negotiate favorable terms for land and ROW agreements including the acquisition, relinquishment and modification of easements, fee land purchases, franchise and permit rights, encroachment resolutions and settlement of damage claims.

Review ROW agreements to ensure that ExxonMobil Pipeline is in compliance with the agreement’s terms and conditions and relevant federal and state requirements.

Steward contract agents in the determination of property ownership through investigation of courthouse abstract and title records, tax maps, and field inspections.

Review agreements to ensure that all necessary forms and legal documents pertaining to the uninterrupted maintenance and operations of ExxonMobil Pipeline assets are completed and processed in a timely manner.

Manage processing and response to improvement notices from the public and private sources with respect to protection of ExxonMobil Pipeline’s interests.

Steward negotiations and settlement claims resulting from pipeline construction, maintenance and operational activities.

Review, evaluate, and as appropriate, authorize payments required to acquire, preserve the right-of-way, franchise agreements, license agreements, permits, etc.

Provide on-site public relations support, including but not limited to, driving to field locations in the event of unusual construction, maintenance, or emergency response situations. 

Participate in the company’s Public Awareness Program implementation.

Interface with operations and maintenance personnel to ensure the protection of property rights and assets and advise Management on matters pertaining to the support of operations with respect to budget and planning.

Participate in response efforts to support Operations during pipeline emergencies throughout the U.S.; usually requires travel and extended work hours.

Be willing and able to travel overnight to a region of responsibility, up to an estimated 20% of work time.

 

Job Requirements

A minimum of two years of College (e.g., AA Degree) or commensurate work experience combined with a minimum of 5 years of experience as a ROW & Claims Agent with either a pipeline or other utility company.

Ability to monitor, manage and hold contract resources accountable to deliver results.

Ability to quickly gain a thorough understanding of company’s policies, procedures, and operations.

Possess a working knowledge of pipeline construction techniques, applicable real estate law, and engineering, appraisal, negotiations, agricultural/land use and valuation (IRWA Agent Development Program, or its equivalent).

Expertise in preparation and interpretation of legal documents and other contract preparation.

Effective communication skills, both verbal and written.

Negotiating skills and experience in claim techniques and procedures; ability to manage complex issues related to landowners, public relations, and property rights.

Excellent public relations skills to represent the company and interface with public officials and private property owners.

Must work effectively with minimal direct supervision, must be able to prioritize multiple tasks; must be flexible and able to work effectively in a team environment.

A valid Driver’s License.

 

Preferred Knowledge / Skills / Abilities

Familiarity with local pipeline construction permitting requirements and approval processes with the local/region/state.  Knowledge of federal jurisdictional permitting a plus.

Analytical skills necessary for problem solving and decision making.

Computer skills in various Microsoft applications (Outlook, Excel, Access, PowerPoint, Google Earth).
